ON THE WORKERS' RIGHT TO CHOOSE TO JOIN THE TRADE UNION——A PERSPECTIVE OF LAW AND ECONOMICS ANALYSIS

Abstract

From the perspective of microeconomics, if the trade union is regarded as the supplier of the service market to provide labor rights protection, then the laborer is the consumer of the service market, as a consumer, he has the corresponding right to know, the right to choose, etc. From the perspective of rational economic man, the laborer will choose whether to join the trade union and choose the most favorable trade union in the case of the right to choose. Based on the premise that workers are consumers and there is a market for workers to safeguard their rights, this paper will use the analytical tools of law and economics, such as consumer choice theory and cost-benefit analysis, to analyze whether workers are willing to join trade unions and how to take measures to encourage workers to join trade unions actively, and to analyze the "free ride" of non-trade union members. In order to improve the enthusiasm and efficiency of trade unions in protecting workers'labor rights.
